Contact: txema@influencers.network.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"2-professionals-only\"><\/span>2. Professionals only<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The service is intended exclusively for companies and professionals acting in the course of their business. By registering you declare that you are not acting as a consumer, that you are 18 or older and that you can bind the company you represent.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"3-what-we-offer\"><\/span>3. What we offer<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>A directory of content creators with search, filters and contact tools. We are an intermediation platform: we are not a party to any agreement between you and a creator, and we do not guarantee that a creator will accept a collaboration or the result of any campaign.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"4-directory-data\"><\/span>4. Directory data<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Profiles combine public information, data provided by creators and our own estimates. Audience metrics, prices and demographics are indicative. We do not guarantee that they are accurate, complete or up to date. You must verify them before hiring.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"5-your-compliance-obligations\"><\/span>5. Your compliance obligations<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>You are solely responsible for ensuring that your campaigns comply with the applicable rules in each market. This includes:<\/p>\n<ul>\n<li><strong>Licence:<\/strong> holding a licence to offer gambling in each country targeted by the campaign, for example DGOJ in Spain, the GGL whitelist in Germany, SPA authorisation in Brazil or AGCO registration in Ontario.<\/li>\n<li><strong>Advertising:<\/strong> complying with rules on timing, content, protection of minors, labelling of advertising and forms of remuneration. For example, in Germany CPA and revenue-share remuneration is not permitted for online gambling advertising.<\/li>\n<li><strong>Platforms:<\/strong> respecting the rules of each network (Twitch, Kick, YouTube, etc.).<\/li>\n<li><strong>Data protection:<\/strong> complying with data protection law when you process creator data. You are an independent controller of the data you export or use outside the platform.<\/li>\n<li><strong>Responsible gambling:<\/strong> not promoting gambling to minors and not presenting it as a source of income or a financial solution.<\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"5a-published-content-and-use-of-contacts\"><\/span>5a. Published content and use of contacts<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>influencers.network collects and displays information to make contact between brands and creators easier, but does not create, review, approve or publish the content of collaborations.<\/p>\n<ul>\n<li><strong>Responsibility for content:<\/strong> all responsibility for the content published and its legality lies exclusively with the creator who publishes it and the company that hires them. This includes the operator promoted, the markets reached, mandatory notices and the rules of each platform.<\/li>\n<li><strong>Fraudulent or unlawful use:<\/strong> we are not involved in, and are not responsible for, any fraudulent or unlawful use of contacts obtained through the platform, in particular advertising for unlicensed operators or advertising aimed at minors.<\/li>\n<li><strong>Exception:<\/strong> this exclusion does not apply to managed services we provide directly. Liability for those is governed by the contract or proposal signed for each campaign (section 9).<\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"6-prohibited-uses\"><\/span>6. Prohibited uses<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>You may not:<\/p>\n<ul>\n<li>extract data automatically (bots, scrapers or crawlers);<\/li>\n<li>resell, sublicense, publish or redistribute the data, unless you are an agency using it for your own clients;<\/li>\n<li>share your account or credentials;<\/li>\n<li>keep exported data for more than 30 days except for an active campaign;<\/li>\n<li>contact creators for purposes unrelated to a commercial collaboration;<\/li>\n<li>use the platform to promote unlicensed operators.<\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"7-managed-profiles\"><\/span>7. Managed profiles<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Some profiles can only be hired through influencers.network. If you contact one of these creators in another way to bypass the platform during your subscription and the following 12 months, you will owe us the greater of \u20ac2,500 or 30% of the value of each collaboration agreed outside the platform as compensation.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"8-plans-credits-and-payments\"><\/span>8. Plans, credits and payments<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<ul>\n<li><strong>Renewal:<\/strong> plans renew automatically for the same period unless you cancel before the renewal date (yearly plans: 30 days in advance).<\/li>\n<li><strong>Prices:<\/strong> shown excluding VAT. Each additional user is billed separately.<\/li>\n<li><strong>Credits:<\/strong> credits included in the plan expire at the end of each month. Pack credits expire after 12 months. They cannot be exchanged for money.<\/li>\n<li><strong>Refunds:<\/strong> amounts paid are not refunded, including pro rata, unless required by law or agreed in writing.<\/li>\n<li><strong>Price changes:<\/strong> we will give you 30 days\u2019 notice.<\/li>\n<li><strong>Payment:<\/strong> by bank transfer, crypto or PayPal against invoice. If you do not pay, we may suspend the account.<\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"9-managed-services\"><\/span>9. Managed services<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Creator search and campaign management services are governed by a separately signed contract or proposal, which prevails over these terms.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"10-intellectual-property\"><\/span>10. Intellectual property<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The platform, its design, the database and its structure belong to us or our licensors and are protected, including by the sui generis database right. You receive a limited, non-exclusive and non-transferable licence for the duration of your subscription.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"11-suspension-and-termination\"><\/span>11. Suspension and termination<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>We may suspend or close your account without refund if you breach these terms, in particular sections 5, 6 and 7.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"12-limitation-of-liability\"><\/span>12. Limitation of liability<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>To the extent permitted by law:<\/p>\n<ul>\n<li>we are not liable for indirect damages, loss of profit, loss of data or the actions of creators or other users;<\/li>\n<li>our total liability is limited to the amount you paid us in the 12 months before the event, with a minimum of \u20ac100;<\/li>\n<li>nothing above limits liability for wilful misconduct or gross negligence.<\/li>\n<\/ul>\n<h2><span class=\"ez-toc-section\" id=\"13-indemnity\"><\/span>13. Indemnity<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>You will hold us harmless against claims, penalties and costs, including legal fees, resulting from your campaigns, your use of the data or your breach of these terms.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"14-changes\"><\/span>14. Changes<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>We may change these terms and will give you 30 days\u2019 notice. If you continue to use the service, you are deemed to accept them.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"15-governing-law-and-jurisdiction\"><\/span>15. Governing law and jurisdiction<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Spanish law applies.
